OUR OBLIGATIONS

The trust of our customers is extremely important to us, which is why we approach the data our users entrusted us with great commitment. We also want to provide clear and transparent information about what information we collect and why we do it.

This Privacy Policy fairly and transparently sets out rules regarding the collection, use, disclosure and storage of personal data obtained from our clients and defines the actions we take to protect them.

All personal data is collected and processed in accordance with applicable legislation on the protection of personal data, ensuring their appropriate security, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, by appropriate technical or organizational measures. The data is collected for specific, explicit and legitimate purposes, to the extent relevant to it (limited to what is necessary) and stored in a form that allows identification of the person to whom it relates, for a period not longer than required to achieve the purposes for which the data has been collected.

The data administrator in the meaning of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of personal data of natural persons in connection with the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (commonly known as "GDPR"), in relation to personal data of users who are natural persons is:

WHO HAS ACCESS TO DATA?

Only authorized employees of our company have access to your data. These persons were trained by the Administrator in the proper processing of personal data and undertook to process them in a way that guarantees the highest level of security of this data.

We never transfer, sell or exchange the data of our users and customers for marketing purposes with other entities not associated with us.

The data may, however, be transferred to some external entities necessary for the provision of our services. Such recipients of data are:

• items providing shipping services,

• entities supporting online payments,

• other trusted service providers used by us to conduct our business: accounting office (accounting services), IT service providers as well as services, tools and scripts used on the website, providers of software solutions in the cloud, a tool for providing e-marketing services.

If required by us by law, we also share your personal data with authorized entities, including relevant judicial authorities. If necessary, we may also transfer your personal data to public authorities for the purposes of combating fraud and abuse.

WILL THE DATA BE TRANSMITTED TO THIRD COUNTRIES?

Your personal data may be transferred to third countries, i.e. outside the European Economic Area (EEA) or to international organizations, but only to entities that provide adequate safeguards and guarantee the rights of data subjects and effective legal protection measures. In particular, this includes the use of the services provided by Google to the Administrator, to the extent necessary to achieve the purposes set out in this Privacy Policy.

The transfer takes place on the basis of a decision of the European Commission (the so-called Privacy Shield) confirming that entrepreneurs based in the United States of America who have joined the Privacy Shield program have an adequate level of personal data protection. You have the right to obtain from the administrator copies of personal data transferred to a third country.

WHAT DATA CATEGORIES DO WE COLLECT AND WHAT ARE THE DATA SOURCES?

The data collected by PPHU SPORTEX, G. Bielecki comes from the persons to whom they relate, i.e. directly from you or from your authorized employees, as well as from publicly available public websites and registers, in particular from the search engine of the National Court Register and Central Register and Information on Economic Activity. We also received your data when you contacted us or subscribed to the newsletter.

We collect information falling into the following categories:

• company name, registered office address, tax identification number

• name and surname of the person acting on behalf of the client, telephone number, e-mail address

• shopping history

• communication history (using the contact form, email, social media or telephone)

• information saved in cookies (about using our website)

• location (IP)

WHAT IS THE PURPOSE OF DATA PROCESSING?

Your personal data is processed for the purpose of implementing sales contracts, taking steps at the request of the Customer before concluding such a contract, as well as for marketing or administrative purposes, including:

• handling queries and notifications, including responses to questions sent using the contact form on the Online Store website,

• registration and maintenance of the User Account - the ability to monitor the status of the order and purchase history,

• order processing (contacting for purposes related to the implementation of the order, payment processing, delivery, sending notifications about order status),

• consideration of complaints,

• making settlements, invoicing,

• archival purposes: to ensure accountability of the performance of obligations arising from legal provisions (storage of accounting documents) and regarding information about customers served,

• marketing goals - statistical and marketing analysis, sending commercial information ordered by the User by e-mail (newsletter),

• creating lists, analyses, statistics for the internal needs of the Administrator (reporting, planning the development of services),

• making and storing security copies - to ensure confidentiality, integrity, availability of data processing systems and ensuring the ability to quickly restore data and / or access it in the event of unacceptable failures.

LEGAL BASIS OF DATA PROCESSING

Data processing requires a legal basis. The GDPR provides several such bases and in the case of activities of our store, we distinguish the following:

• the necessity of processing to conclude or perform a contract to which the Customer is a party (Article 6 paragraph 1 point b of the GDPR),

• fulfilling our legal obligations (Article 6 paragraph 1 letter c of the GDPR),

• the necessity of processing for purposes resulting from legitimate interests pursued by the administrator or a third party (Article 6 paragraph 1 letter f of the GDPR),

• your voluntary consent to the use of personal data expressed by the Customer or User (Art.6 para. 1 let.a GDPR).

WHAT IS THE DATA STORAGE PERIOD?

The personal data of the User will not be stored for a longer period than is necessary to achieve the purpose for which the data was collected, i.e.

• for the duration of the order, as well as for the time during which the Administrator is required to store sales documents. We are obliged to store personal data that we process based on tax and accounting legal provisions for a period of 5 years after the end of the year in which the tax payment deadline expired.

• until the expiry of the limitation period for claims under the provisions / contract concluded - in the case of processing for the purpose of performing the contract, pursuing or defending claims;

• until you unregister from the Online Store - regarding processing for the purpose of registering and maintaining a User Account;

• for an indefinite period, but not longer than until you object or withdraw your consent - for marketing purposes (sending a newsletter)

• a period of 13 months when creating personalized campaigns (profiling, tracking website traffic based on cookies)

• until you resign from receiving a reply (withdrawal of consent) - in the case of questions sent via the contact form

After the indicated periods of time, the data will be securely deleted, destroyed or anonymized (encrypted in a way that prevents identification of the user). In the latter case, they will be further stored (processed) solely for statistical and historical purposes.

REGISTRATION IN THE STORE

Only registered Users who have positively verified their business profile have access to the offer presented on the website.

Creating an account requires providing identifying information in the form of: company name, registered office address, tax identification number, e-mail address (data marked with an asterisk in the application form). In addition, we require from our clients an excerpt from the register in which they have registered their activities, certificates of assigning REGON and NIP numbers and registration for VAT purposes. In the absence of mandatory data or documents when registering, the Customer will not be able to use the Online Store.

All data collected after registration (and positive verification) will be processed in accordance with this Privacy Policy. In the event that we use the user's personal data after obtaining the consent of the user, the user has the option of withdrawing consent to data processing and deleting the data at any time (how this can be done is described in the section "Rights of persons whose data is collected")

Personal information stored in the account is stored as long as the User has the account. We would like to kindly inform you that other storage periods may apply to all personal data collected in order to conclude a contract with the User - placing an order and its implementation, and due to the legal obligation to process such data.

What are cookies?

Cookies are small text files containing IT data that allow the server pages to function properly. They are stored in end users' devices (computer hard drive, laptop, smartphone memory card or tablet). These files allow the user's device to be recognized and the appearance adjusted to individual needs. Cookies perform a very important function, facilitate the use of the Internet, allow better, faster, safer and more convenient use of it. Cookies are needed to log in the user and to optimize the use of websites.

What are cookies used for?

Cookies can provide very important information about activity of the user, the content browsed, he searched history, user interests, and the way the user adapted the page to personal needs. However, they are not used to identify the user. They provide information about computer data and web browsers by providing small text files that are stored on the end the User accessed the website from. Cookies can therefore be used to:

Internet analysis

To constantly optimise and improve our offer, we use so-called tracking technologies. We use Google Analytics and Google Tag Manager for this purpose.

Google Analytics

This tool uses data from our website to analyse Google Inc. (Universal) Analytics website statistics from Google Inc. (www.google.pl). Google (Universal) Analytics uses methods that enable the analysis of the user's use of the website, e.g. cookies, which are text files saved on the user's computer. The information generated in this way regarding the visit to this website is usually transmitted to a Google server in the USA and saved there. If the IP anonymization function is activated on this website, the user's IP address is shortened by Google before it is transferred within the territory of European Union Member States or other signatory countries of the agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. The anonymized IP address sent by the user's browser as part of the Google Analytics service is not combined with other Google data.

The user can avoid sending the data generated by the cookie files related to his use of the website (including the IP address) to Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following address: http://tools.google.com/dlpage/gaoptout?hl=pl

PROFILING

Please be advised that your personal data may be processed in an automated manner (including in the form of profiling) to the extent that is necessary to provide advertising and marketing services. As part of profiling, your previous purchasing decisions may be analysed, based on which we will try to customise the future offer. Automated processing or profiling will not have any legal effect or significantly affect the user's situation.

CONSEQUENCES OF NOT SUBMITTING DATA

Please be advised that you have no statutory obligation to provide personal data, however this obligation may arise from specific provisions. The consequence of not providing personal data is the inability to provide services to you, in particular the inability to provide details of the offer published on the site and conclude a contract for the sale of goods.

If required by law, we may require providing other data necessary, e.g. for accounting or tax reasons. In all other respects, providing your data is voluntary.

THE RIGHTS OF PEOPLE WHOSE PERSONAL DATA CONCERNS

Your rights regarding processed data

Please be assured that you can exercise all your rights under applicable law. You can request from the Administrator, among others, access, rectification or even deletion of your data, restriction of their processing, data transfer, not being subject to automated decision making, including profiling. You also have the right to object to the processing of your personal data.

You may exercise your rights in relation to:

• data correction requests: you will notice that your data is incorrect or incomplete;

• requests to delete data: your data will no longer be necessary for the purposes for which it was collected by the Administrator; you withdraw your consent to data processing; you object to the processing of your data in advance; your data will be processed unlawfully; data should be deleted in order to comply with the obligation arising from the provision of law;

• requests to limit data processing: you will notice that your data is incorrect - for a period allowing the Administrator to check the correctness of your data; your data will be processed unlawfully, but you will not want them to be deleted; your data is no longer needed by the Administrator, but you may need it to defend or pursue claims; or you object to the processing of data - until it is determined whether the legitimate grounds on the part of the Administrator prevail over the basis of the objection;

• requests for data transfer: the processing of your data is carried out on the basis of your consent or the contract concluded with you and the processing is carried out automatically.

The right to object to the processing of your data

You have the right to object to the processing of your personal data when:

• the processing of your personal data is based on a legitimate interest, or for statistical purposes, and the objection is justified by the special situation in which you find yourself,

• the Administrator intends to process or process data for direct marketing purposes; opposition may also apply to data processing in the field of profiling.

Right to lodge a complaint

Exercise of Privileges

To exercise the above rights, you can contact the Administrator by sending a relevant message in writing or also by e-mail, using the contact details indicated in this Privacy Policy.

Withdrawal of consent may take place by sending an appropriate statement. DATA SAFETY

The administrator processes personal data using computer systems and software ensuring the security of processing this personal data at the highest level (such as, among others, encryption with the SSL coding system and anonymization of transmitted information, cyclical changes in system access passwords). PPHU SPORTEX, G. Bielecki processes your personal data outside the IT system using technical and organizational measures to ensure the highest level of security of personal data processing.
